LandPrism’s role as controller and processor
LandPrism is the data controller where we determine the purposes and means of processing personal data, including account creation, user and team administration, billing, service communications, website analytics, platform security, fraud prevention, legal compliance and the management of licensed property data.
Where a customer uploads documents, workspace content or other personal data to the Services and LandPrism processes that data solely on the customer’s behalf and under the customer’s instructions, the customer is the data controller and LandPrism acts as a data processor. That processing is governed by the applicable customer agreement and Data Processing Agreement.
If you are an individual whose personal data has been provided to LandPrism by one of our customers, you should normally contact that customer first to exercise your data-protection rights in relation to that processing.

Where we process such information on behalf of a customer, we do so in our capacity as processor and in accordance with the customer’s instructions and our Data Processing Agreement.
Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. Information automatically collected

The information we collect includes:
- Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services(such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps'), and hardware settings).
- Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

Information obtained from public and third-party property data sources
LandPrism provides property information and due-diligence services using information obtained from official, public and licensed third-party sources. Depending on the property and features used, this may include property addresses and postcodes; title numbers and property identifiers, including UPRNs; registered-title and land information; property boundaries, polygons and related geospatial information; EPC information; planning, environmental and other statutory property information; and other official property-record information that may relate to an identified or identifiable individual.
Sources may include HM Land Registry, the Ministry of Housing, Communities and Local Government, the Energy Performance of Buildings Register, local authorities, Ordnance Survey and other official or licensed property-data providers. Some information is obtained from publicly accessible records or datasets rather than directly from the individual. Where property-level information can be linked, directly or indirectly, to an identifiable individual, we treat it as personal data and process it in accordance with applicable data protection law.
Information obtained indirectly
Where we obtain personal data from a public source, official register, licensed data provider or customer rather than directly from an individual, this Privacy Policy explains the categories of personal data we may process, their sources, our purposes and lawful bases, recipient categories, retention approach and the rights available to the individual. Where required by applicable law, we will provide additional information or take other appropriate transparency measures.

HM Land Registry National Polygon Service End-User Records
Where you access functionality containing information from HM Land Registry’s National Polygon Service (NPS), we may be required under our licence to maintain End-User Records. These may include your name, contact details, account or user information, IP address, and records of your access to and use of NPS information. We use this information to administer and demonstrate licensing compliance, maintain usage records, support audits, and help prevent misuse or fraud.
2. HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
- To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
- To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.

- To provide property due-diligence information. We process property and building information obtained from official, public and licensed third-party sources to identify properties, provide context, generate reports and findings, and deliver the property due-diligence functionality of the Services.
- To comply with third-party data licensing and audit requirements. Where you use licensed datasets such as NPS information, we process user identity, contact, IP address and usage information to comply with licence terms, maintain audit records, protect data-provider rights and prevent misuse.
- To maintain the accuracy, provenance and appropriate use of property data. We may process source, date, licence, property identifier and usage information to maintain traceability of information used through the Services and to investigate or address data-quality, licensing, security or misuse issues.
- To process Customer Content on behalf of our customers. Where customers upload documents, workspace content or other personal data, we may process it on the customer’s behalf and in accordance with their instructions in order to provide the Services.
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?
In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e. legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfil our contractual obligations, to protect your rights, or to fulfil our legitimate business interests.
The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. Depending on how you interact with our Services, we rely on different legal bases to process your personal information:

- obtaining, organising and presenting official and publicly available property information for property due-diligence purposes;
- maintaining the provenance, accuracy and security of information provided through the Services;
- complying with contractual licensing, audit and usage-control requirements imposed by our data providers, including HM Land Registry;
- preventing fraud, misuse, unauthorised extraction and other abuse of the Services or licensed datasets; and
- establishing, exercising or defending legal rights.
Lawful-basis summary
As controller, we generally rely on: performance of a contract for account and team administration; legal obligations for billing, tax and payment administration; consent for website analytics and cookies and for marketing communications where required; and legitimate interests for property-data sourcing and due diligence, NPS compliance records, and security, audit logs and fraud prevention. Where customers upload documents, workspace content or other personal data, LandPrism processes that content as a data processor on the customer's behalf and in accordance with the customer's instructions; the customer remains the controller for that content under the applicable customer agreement and Data Processing Agreement.
4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In Short: We may share information in specific situations described in this section and/or with the following third parties.
Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ('third parties') who perform services for us or on our behalf and require access to such information to do that work.
Data licensors, public authorities and auditors. Where necessary to comply with the terms on which third-party property data is supplied to us, we may disclose relevant personal information and usage records to the applicable data provider, its authorised representatives or auditors. Where you access NPS information, HM Land Registry, its personnel, representatives or appointed auditors may be given relevant End-User Records and associated compliance information where required under the applicable licence. Such disclosures are limited to information reasonably necessary for licensing compliance, audit, fraud prevention, investigation or enforcement.
The third parties we may share personal information with include:

Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

6. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?
In Short: We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.
As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, 'AI Products'). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Policy govern your use of the AI Products within our Services.
Use of AI Technologies
LandPrism uses OpenAI’s API to provide AI-assisted document analysis, text analysis, AI search, chat, legal and property research assistance, and report-generation functionality. Depending on the feature used, we may share relevant customer inputs, uploaded documents, text, extracted information, prompts and outputs with OpenAI in order to provide the requested AI functionality.
LandPrism does not use Customer Content to train its own AI models. OpenAI states that inputs and outputs submitted through its API are not used to train or improve its models by default.
Our AI features are designed to assist users with research, analysis and workflow tasks. They do not make solely automated decisions that produce legal or similarly significant effects on individuals. AI-generated outputs are intended to support, not replace, professional judgement and must not be relied on as the sole basis for a legal, property, financial or other material decision.

How We Process Your Data Using AI
Personal information processed using our AI Products is handled in accordance with this Privacy Policy and our agreements with third-party providers, and is subject to the security measures described in Section 8 (How Do We Keep Your Information Safe?).
7. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this Privacy Policy unless otherwise required by law.
We retain account and team records, customer documents and workspace content, support records, AI artefacts, security and audit logs, and property-data, licensing and compliance records for as long as necessary to provide the Services and meet the applicable contractual, licensing, security, legal, audit and backup-retention requirements. Billing, payment and tax records are retained for the period required by applicable financial and tax requirements. Suppression, opt-out and objection records are retained as necessary to honour those choices.
We may retain personal information for longer where necessary to comply with a licence, legal obligation, audit requirement, security incident, legal claim, contractual obligation or applicable backup-retention process.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
HM Land Registry NPS records
Where we maintain End-User Records in connection with HM Land Registry National Polygon Service information, those records may be retained for the duration required by the applicable executed HM Land Registry licence.
The applicable licence requires relevant End-User Records to remain available while the licence is in force and for twelve months after the licence ends.
This retention may therefore continue after your LandPrism account has been closed where necessary to satisfy the applicable licensing, audit, fraud-prevention or compliance requirement.
Energy Performance Certificate information
LandPrism may obtain property-level Energy Performance Certificate information from the Energy Performance of Buildings Register and associated government datasets.
This information may include property address, postcode, property characteristics, energy-efficiency ratings and recommendations and other information relating to the energy performance of a building.
Where EPC information contains an address or can otherwise be linked to an identifiable individual, we treat the relevant information as personal data.
We process this information for property identification, property research, professional property due diligence and the generation of property-related reports and findings through LandPrism.
We do not use EPC-derived personal information obtained for these purposes to build consumer marketing profiles or for unsolicited direct marketing to property owners or occupiers.
8. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We aim to protect your personal information through a system of organisational and technical security measures.
LandPrism uses access controls, authentication measures, role-based authorisation, rate limiting and audit logging to help protect the Services and investigate unauthorised access, misuse or security incidents. Access to personal information is restricted to authorised users and personnel with an appropriate business need. These measures are designed to reduce the risk of unauthorised access, loss, misuse or alteration of personal information. However, no method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security.
9. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market to children under 18 years of age.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 11. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.
